WEBSHOP REGULATIONS

1 General provisions:

2 The terms used in the Regulations shall mean:
- Shop - online shop ajfood.co.ukowned by AJ Food
- Customer - an entity that has made a purchase on the website.
- Consumer - Customer, a natural person making a legal transaction with the seller not directly related to his/her business activity - Civil Code Art.22.
- Service - the website at www.ajfood.pl under which the shop operates.
- Warehouse - Warehouse of AJ Food Sp. z o.o. 37 Wileńska Street, 84-300 Lębork
- Regulations - these regulations of the shop www.ajfood.pl
(3) The object of the shop is the online sale of materials for serving in catering establishments. A detailed list of products and their unit prices can be found on the shop's website.
(4) Sales are made via the Internet in the form of a distance contract between the orderer, hereinafter referred to as the Customer, and the seller, hereinafter referred to as the Shop.
5. Registration in the shop
- The shop's customer may only be a natural or legal person, or an organisational unit without legal personality and to which the law grants legal capacity, with legal capacity and an active e-mail account.
- There are two possibilities to make purchases in the web shop. The customer can make purchases in the shop without registration, each time providing all the necessary data for full shopping and shipping. To make purchases without registration, an active email address is required, to which an order confirmation link will be sent. Only after email confirmation will the order be processed. Acceptance of the shop's Terms and Conditions is a prerequisite for making purchases on the website.
- The customer is able to make purchases in the shop after registering on the website. Registration takes place by selecting the "Create an account" option available on the shop website under the payment data form. The data provided by the customer is registered and allows multiple purchases to be made on the created account. The condition of registration on the site is acceptance of the Rules and Regulations of the shop.
- It is in the Customer's interest that the data provided by him/her is correct and complete. The shop is not responsible for the consequences resulting from incorrect data provided by the Customer. The Customer is obliged to keep the data contained in the registration form up to date. In case of any doubts, it is considered effective to contact the shop staff.
- By making a purchase from the website, you consent to the processing of the personal data provided in the form. Personal data is subject to protection and will be stored in accordance with the security principles specified in the Personal Data Protection Act of 29 August 1997 (Journal of Laws of 2002, No. 101, item 926, as amended). The data administrator is the shop. The customer has the right to free access to his/her data, including the right to edit it, as well as to demand the cessation of its processing and its removal from the database.
- Viewing the goods presented in the shop does not depend on registering on the website.
6 Orders and basket
- The customer can place orders via the webshop: www.ajfood.pl.
- Orders will only be fulfilled if goods corresponding in quantity and type to the order placed are in stock.
- If the goods covered by the order are not available in full, the Customer is informed by e-mail or telephone about the status of the order and can decide (by e-mail) on the way of its further processing (partial processing, extension of the entire order, cancellation of the entire order). Failure to indicate the way of further processing the order within 2 working days after the day on which the information was sent is deemed as order cancellation by the Customer.
- If the goods covered by the order are available, the shop sends, within one working day after the day on which the order was placed, a message about the status of the order and the delivery time to the e-mail address provided in the form.
- It is only possible to cancel an order if it has not been packed and can only be done by telephone on +48 881 949 734 and confirmed by email sklep@ajfood.pl.
7 Prices
- All prices given in the shop are expressed in Polish zloty (PLN) net and gross including VAT. The price does not include the cost of delivery of the ordered goods. The amount of the delivery costs depends on the method of delivery and is determined in accordance with the rules specified in item 11 of the Terms and Conditions.
- The shop reserves the right to change prices of goods offered for sale, as well as the right to introduce new goods to the shop's offer, conduct and cancel promotional actions on the shop's website. Changes to the information contained on the website, including changes to the prices of goods offered and promotional actions, shall come into effect the moment they are posted on the shop website.
8 Goods
- All goods offered by the shop are full-quality products.
- The shop reserves the right to organise promotional sales and sales for a limited number and limited types of goods.
Promotional sales and sales will continue until the promotional goods are exhausted.
Order processing will be determined by the order of orders placed. - The shop presents photographs of the goods on offer. The presented photographs are demonstrative images. The goods may differ from the photographs, in particular as regards colours. The differences cannot constitute grounds for any claims by the Customer.
- The goods offered for sale are provided with a description together with technical data. In case of any doubts, the customer has the possibility to consult the shop staff at the phone number +48 881 949 734 or by e-mail at: sklep@ajfood.pl to obtain detailed information about the goods.
9 Payment methods
- The following methods of payment for the ordered goods are envisaged:
- Transfer - prepayment on account
- The payment system przelewy24.pl administered by PAYPRO S.A.
- If payment is made by bank transfer, payment for the ordered goods must be made to the bank account whose number will be shown in the shopping basket and will be specified in the e-mail sent to the Customer with the order confirmation.
In the title of the transfer, please indicate the name and surname or the name of the customer as well as the order number given in the e-mail.
The order will be processed once the funds have been received in the bank account provided. - If payment is made via the przelewy24.pl system, the payment is automatically credited to the shop's account and the order is processed within 2 working days, provided the goods are in stock.
10. lead time
- The total order lead time consists of the order lead time, which is calculated from the day the Customer places the order and includes the time needed to pack the order and forward it for dispatch, i.e. 24-48 hours, and includes the delivery time of the order by the selected courier service provider if the goods are in stock. If the goods are temporarily out of stock, the Customer is informed in a separate e-mail about the expected delivery time.
11 Delivery
- Deliveries of ordered goods will be made by one of the following methods, at the Customer's choice:
- as a courier parcel - PLN 19.00 net (PLN 23.37 gross) for a package up to 20 kg, each additional package is charged extra 19.00 PLN net / piece
- in the form of a parcel for collection from a parcel machine - PLN 19.00 net (PLN 23.37 gross) for a parcel within the limitations of a parcel machine
- in the form of a pallet consignment - 150 PLN net (PLN 184.50 gross)/ pallet.
- In the case of selection of a courier parcel with payment by direct transfer, delivery time is up to seven working days; the amount of the PLN 19.00 net for each package up to 20 kg.
- For orders over PLN 1000 net delivery throughout Poland is free of charge.
12 Complaints
- The products offered in the shop are subject to technical inspection. The shop guarantees the purchased goods for a period of 6 months from the date of receipt/delivery of the goods.
- The guarantee covers defects due to reasons inherent in the goods sold, in particular technical, manufacturing, material or design defects.
- In the event that the Customer receives goods that are affected by defects as above, the Customer may lodge a complaint, In order to exercise the rights under the guarantee provided, the Customer is obliged to report the defect, within the time limit and in the manner described below.
- Complaints can be lodged by telephone on +48 881 949 734 or by email to sklep@ajfood.pl, stating the order number and the reasons for the complaint.
- In order to make use of the guarantee, the defect must be reported immediately, no later than 14 days from the day on which the defect was discovered, and the product must be presented together with the proof of purchase or invoice. This can be done by contacting sklep@ajfood.pl.
- If the defect report is deemed justified, the affected goods will be replaced with new goods.
- The guarantee does not cover goods whose defects have been caused:
- improper storage
- misuse of the product
- mechanical damage
- repairing the goods yourself.
13 Return of goods
- Within 14 days from the date of delivery of the ordered goods, the Consumer has the right to withdraw from the contract without stating a reason by making an appropriate statement in writing In accordance with Article 27 of the Consumer Rights Act (Journal of Laws 2014, item 827) by concluding a "distance contract".
- In the event of withdrawal from the contract, the delivered goods that were the subject of the order must be sent to the address of the shop together with the statement of withdrawal or send the statement electronically. The shop reserves the right not to accept cash on delivery parcels.
- Together with the declaration of withdrawal from the contract, the Consumer is obliged to provide the proof of purchase together with information on the bank account number and details to which the purchase price of the goods is to be refunded. The Shop provides for the possibility to carry out a replacement order, at the Consumer's choice and in accordance with the ordering procedure.
- The condition for exercising the right of withdrawal is that the goods meet the following conditions:
- was not used;
- has not been damaged in any way;
- is complete;
- is not packaged;
- is originally packed and packaged;
- the packaging bears no signs of damage and any security features are intact;
- suitable for resale.
- In the event of an effective withdrawal from the contract, the price will be refunded within 14 working days from the date of delivery of the returned goods to the shop, by transfer to the bank account provided with the withdrawal declaration. In the event of withdrawal, the Consumer shall be entitled to a refund of the costs incurred. If, at the time of concluding the contract, the Consumer has chosen a method of delivery of the item other than the cheapest ordinary method offered by the Seller - the Seller shall not be obliged to reimburse the Consumer for any additional costs incurred by the Consumer in excess of the cheapest method.
- The shop will not reimburse the cost of sending the returned goods to the shop or the cost of the commission incurred by the Consumer in making the online purchase.
- The right of withdrawal shall not apply if the consignment is affected by mechanical damage of external origin. Before accepting the consignment delivered by courier, the Consumer is obliged to check whether the packaging has not been damaged in transit. In particular, attention should be paid to the condition of the tapes stuck to the consignment. If the packaging of the consignment bears the signs of damage or if the tapes are torn off, the consignment should not be accepted and a damage protocol should be drawn up in the presence of the courier and the shop staff should be contacted as soon as possible. Checking the consignment upon receipt is a prerequisite for taking into account any claims made by the Consumer on account of damage or robbery of the consignment in transport.
14 Final provisions
- All brand names and trademarks displayed in the shop are the brand names and trademarks of these companies.
- The shop reserves the right to amend these terms and conditions at any time. Amendments to the terms and conditions shall come into effect from the date the terms and conditions are posted on the shop website.
- The customer is obliged to accept the provisions of the terms and conditions when placing an order. In the event of changes to the terms and conditions, the provision of the terms and conditions as current at the time of sending the order confirmation shall apply to orders which were confirmed by customers while the previous terms and conditions were in force.
- The current wording of the terms and conditions is available on the shop's website.
- To the extent not covered by these regulations, the provisions of the Civil Code and relevant laws shall apply accordingly.
